Terms and Conditions

Draft for legal and business approval

Proposed website and enquiry terms, 1 October 2026. These are not a property purchase contract. A solicitor should review them and the offer documentation before publication. Resolve the commercial points below and ensure all website claims are consistent with the approved terms.

About the business

The House Exchange Ltd, company number 17436842. Registered office: C/O Walkers Accountants Ltd Suite 3 Aireside House, Royd Ings Avenue, Keighley, West Yorkshire, England, BD21 4BZ. Email: info@thehouseexchange.co.uk. The House Exchange is a direct property buyer, not an estate agency acting for the seller.

Enquiries and offers

Sending an enquiry or discussing an offer does not itself require you to sell. Give accurate information and tell us if material details change. We may need further information about ownership, title, condition and authority to sell. An initial discussion is not a completed valuation or an unconditional commitment to buy. Formal purchase terms must be recorded in the transaction documents.

Written offer details — proposed safeguards

Before you decide, the written offer should identify the buyer, price, expiry date and outstanding checks. Any proposed price change should be explained in writing and requires your agreement; an offer is not an independent market valuation. You should be free to choose your own solicitor. The written costs arrangement must explain any difference in coverage between your chosen solicitor and a recommended firm, together with any referral benefit. No option, exclusivity, title restriction or authority to market your home arises merely from using this website. Any separate agreement needs its own clear terms and independent advice. Confirm applicable cancellation rights for each agreement with a solicitor; do not assume that every property agreement has a 14-day cancellation period.

The legal process

In England and Wales, a property sale is not legally binding until contracts are exchanged. Separate rules apply elsewhere; obtain advice from your own solicitor. These website terms do not replace conveyancing documents. GOV.UK explains offers and negotiations.

Costs and timescales requiring confirmation

The business has confirmed its intended free-service and selling-cost promises. Before launch, specify in writing which legal and other selling costs are covered, how payment works, any limits, and what happens if a transaction does not proceed. Do not introduce hidden charges or exclusions inconsistent with advertising. Confirm when any 7–14-day period starts, eligibility and dependencies. Define the seven-day funds reservation, expiry and consequences separately from any guarantee of completion.

Independent advice and urgent circumstances

General information is not tailored legal, tax, debt or financial advice. Seek appropriate independent advice before deciding to sell. An enquiry or cash offer alone does not suspend repossession or court action. Only describe an outcome as guaranteed where it can lawfully and accurately be guaranteed; resolve the current repossession claims with a solicitor before publication.

Using the website

Use the website lawfully. Do not attempt unauthorised access, interfere with its operation or submit malicious material. The site may be updated or temporarily unavailable. Links to other sites do not make us responsible for their content or privacy practices. No provision is intended to exclude rights or liability that cannot lawfully be excluded.

Privacy and complaints

Personal information is addressed in the approved Privacy Policy. Complaints may be addressed to Filip Kisely at info@thehouseexchange.co.uk or the registered office. Read the separate Complaints Procedure once approved.

Ownership and identity checks

A proposed purchase may require evidence of identity, ownership and authority to act, including where an executor, attorney or company representative is involved. The responsible solicitor or approved verification provider should explain what is needed and provide a secure route. Confirm which checks The House Exchange performs itself and any applicable regulatory obligations before making compliance claims.

Approval before launch

Confirm the geographical service area, applicable law and consumer-rights wording with a solicitor, the full offer and costs process, reservation terms, claims evidence and any redress membership. Add the effective date only when the terms are approved. Future changes should not retrospectively alter an agreed property contract.
